This is taken from my seminar that I did for the Michigan Association for Justice in June 2010. The most important tip to settle cases for more money is that you have to try cases.

This is because some insurance companies will make very unreasonable settlement offers and play hardball because they want to see what a personal injury lawyer will do. With the computers and verdict reporting software that’s out there, it’s really easy for an insurance company or a trucking company to do a verdict search on a lawyer and a law firm, to find out about that lawyer’s reputation, and his willingness to take cases to trial. So they can find out pretty quickly if it’s been 15 years since that lawyer has tried a case. From that, the insurance companies know whether to play hardball, or whether they should settle faster and for more money. And if a lawyer doesn’t take cases to trial, or have a reputation for being willing to take cases to trial, that insurance company knows that it can always settle that case cheap.
